Moscow summons Belgian envoy over seizure of state assets, threatens retaliation

Moscow
has summoned the Belgian ambassador to lodge a protest over the
freeze of its state assets. It said that Moscow may consider
retaliatory measures against Belgium if the assets are seized,
including against Belgium diplomatic property in Russia.
This
comes after Belgian bailiffs notified Belgian, Russian and other
international companies of the seizure of assets belonging to Russia
at the behest of the Isle of Man-based Yukos Universal Limited, a
subsidiary of the Russian energy giant, which was dismantled in 2007.
They have given the target companies a fortnight to comply.
“The
frozen Russian assets include accounts of the Russian Embassy and
Russia’s Permanent Mission to the UN. Even without any further
analysis, this means a blatant violation of international law. We
don’t yet know what the official position of our Belgian partners
is, but at first sight, this seems to be an excessive act,”
Russia's Justice Minister Aleksandr Konovalov said.
Russia
will appeal the court’s arrest of Russian property, Russian
presidential aide Andrey Belousov said. According to the official,
“the
situation with the arrest of the property is politicized, [and]
Moscow hopes to avoid a new escalation in relations.”
On
Thursday, Russia’s Foreign Ministry said it
views Belgium’s actions as “an
unfriendly act” and “a
blatant violation” of
the norms of international law, adding that it could consider
retaliatory measures against Belgium if the assets are seized.
“The
Russian side will have to consider the adoption of adequate
retaliatory measures against the property of Belgium located in the
Russian Federation, including the property of the Embassy of Belgium
in Moscow, as well as its legal entities,” the
Russian Foreign Ministry said in a statement.
Belgian
Ambassador to Russia Alex Van Meuwen said he would immediately inform
Brussels about Russia’s statement.
A
letter accompanying the bailiffs notice , reportedly drafted by the
law firm Marc Sacré, Stefan Sacré & Piet De Smet, accused
Moscow of a “systematic
failure to voluntarily follow” international
legal judgments.
The
addressees included not just local offices of Russian companies, but
international banks, a local branch of the Russian Orthodox Church,
and even Eurocontrol, the European air traffic agency headquartered
in Brussels. Only diplomatic assets, such as embassies, were exempt.
The
situation was not unexpected, and Russia is considering a number of
measures to deal with possible asset seizures both in Belgium and in
other countries, said Andrey Belousov.

Russia
has not accepted the ruling, saying it disregards widespread tax
fraud committed by Yukos, and constitutes a form of indirect
retribution for Russia’s standoff with the West over Ukraine.
Earlier this month, the Russian ministry of justice said it would
take “preventative
measures” to
avoid property confiscation, and challenge each decision in national
courts.
A
separate ruling by the European Court of Human Rights (ECHR) last
summer awarded Yukos shareholders €1.9 billion in compensation.
Russia’s Dozhd channel quoted ECHR representatives as saying that
the reported seizures are not related to its legal decision as
several media reports have previously suggested.
Neither
Belgium, nor Russia have yet released official statements about
potential asset seizures.
Russia
spent much of the 1990s embroiled in legal squabbles with several
foreign creditors, who attempted to seize its property abroad, but
each time the dispute was settled without asset confiscation.
France freezes Russian state assets, Moscow plans to appeal
French
law enforcement has frozen the accounts of Russian companies operated
by the French subsidiary of VTB, Russia’s second-largest bank,
officials told RBC TV channel. Diplomatic accounts were briefly
frozen as well, but have since been unlocked.
“As
of this morning [diplomatic accounts] were unfrozen… The sums are
small, some dozens of thousands of euros, [but] Russian companies'
accounts are still frozen,” VTB CEO Andrey Kostin said. “We are
working on the problem with our lawyers now.”
The
information was also confirmed by the president of VTB 24, Mikhail
Zadornov, who said that the case is connected to Yukos Universal
Limited, a subsidiary of the Russian energy giant, which existed from
1993 to 2007.
The
news comes amid developments from Belgium, where Russian state assets
are facing seizure to secure payment of a contested Russian debt to
the former owners of Yukos. The company went bankrupt after the
Russian government demanded that it paid due taxes that it had been
evading for years.

Europe expropriating taking over private, Russia’s Church owned,
NGOs, and state properties of Russia, including diplomatic
properties, is a warning to the Chinese government and investors.
The easiness with which the EU arbitration and human rights courts
expropriate the foreign nationals owned properties is dizzying. This
demonstrates that the property ownership protection in the EU and
across the Commonwealth is annulled and void. China, which is buying
the European and North American properties and assets, might be up to
a rude awakening very soon.
Russian
government and businesses have to stop pretending that it’s
business as usual and take more decisive steps like, freezing all
repayments of foreign debt until the situation is resolve; freezing
all the deliveries of gas to Europe until there are guarantees of
Russia’s assets safety; suspension of the diplomatic missions to
the EU; denouncing the membership in Belgium based SWIFT and other
steps.
We
have to keep in mind that Russia’s state assets belong to the
people of Russia. The EU’s attempts to extract 1.8 billion Euros
and 50 billion Euros from the people of Russia means to hurt the
people. The EU sanctions have already resulted in sharp increase in
mortality rate in Russia. The EU sanctions kill Russian people, just
as effectively as the EU junta kills Russian Ukrainians by military
means and the blockade of food, water and medicine. Just as Ukraine
is blocking and redirecting the natural river flow into Crimea and
causing the ecological catastrophe in Crimea itself and in the Black
sea around the peninsula.
The
mood on the Russian street is anger toward Europe and the US, and
unyielding understanding of mortal danger coming from the West.
European countries and the USA express desire to own territories of
Russia without Russians. Essentially, facing imminent death, Russians
intent to win, or to take Europe and the US with them.
The
bottom line: if Russia pays this extra-judicial European court
actions, it will open the floodgate for all kinds of frivolous
lawsuit demanding trillions of dollars from the Russian taxpayers.
To
say that the European courts abuse the Russian taxpayers is an
understatement.
The
Yukos extortion is just a testing ground. I see the Ukraine’s
lawsuits for Crimea and Donbass are coming down the European court
system pipes. Russia has to put a stoppage for this now, before it’s

Nothing new here, just updates.
What
everything comes down to is that you can’t pursue a deliberate
policy of encirclement without eventually provoking the country you
encircle to strike back. The West really overstepped their mark by
betting everything on gaining Ukraine as the last piece of their
encirclement puzzle. If the West wanted another outcome it would have
treated Russia completely different, creating genuine partnership
with it, alas that was never a goal from the part of the West.
