Mr Banks, the MP for Epsom, has been in the Auckland District Court defending himself against claims relating to his failed 2010 Auckland mayoral campaign.
Retired Wellington accountant Graham McCready believed that Mr Banks wrongly signed donations off as anonymous and brought a private prosecution.

Mr McCready said Mr Banks acted despite knowing where the campaign donations came from.

Judge Phil Gittos said on Wednesday it is clear the electoral form that was returned was false.

The judge said the evidence shows an apparent intention of Mr Banks to treat donations from internet entrepreneur Kim Dotcom as anonymous.

On Tuesday, the court was told John Banks was kept at arms' length from campaign finances. However Mr Dotcom gave evidence, saying he was asked to split a $50,000 donation to keep it anonymous.

Outside court on Wednesday, Mr Banks told reporters the decision is wrong and he will absolutely plead not guilty.

An earlier police investigation ruled that there was not enough evidence.
